TERMS AND CONDITIONS
Subject to these Terms and Conditions Aviation Parking Ltd T/A Skyway Airport Parking ("Aviation"), its' agents, staff, representatives, subcontractors and or any person appointed by Aviation will take due care in providing parking or cleaning services and or any other services requested from time to time by the customer ("the services") in accordance with proper standards of workmanship.
"Vehicles stored and driven at owners risk."
Timing of Services
Aviation undertakes to carry out and complete the services at the nearest possible time requested by the customer, however, no responsibility will be taken for the vehicles state of cleanliness (excepting where workmanship is the fault) if flights are delayed, incorrect arrival times are given, incorrect instructions are given or for any other reason outside of Aviation's control. Kerbside service: (Aviation) in undertaking guarantees of being at the terminal will wait 10 minutes after the due arrival time for departure at the terminal thereafter each 15 minutes is chargeable at $10 at Aviation's discretion. The conditions for guarantees of being at the terminal is subject to the booking time being re-confirmed not more than 30 minutes prior to booked time.
Premises
Aviation's premises means and includes all or any land and/or buildings which are owned or leased by Aviation or of which Aviation has a right of use or occupancy. The premises used for storage of the customer's vehicle and the movement of the vehicle between premises shall be at the discretion of Aviation.
Damage or Loss
The vehicle and all its contents remain at all times at the customer's risk in respect of loss or damage however caused, except to the extent of a claim for loss or damage accepted and paid by Aviation's Public Liability insurers (if any). Aviation shall be under no liability to the customer or anyone else for any special, incidental, indirect, or consequential loss or expense (including loss of profit) suffered by the customer and arising out of a breach by Aviation or loss or damage to the vehicle or it's contents. Aviation will not be responsible for removal of any vehicle or infringement notice costs for any vehicle left unattended or unreceipted by Aviation whether inside or outside of Aviation designated parking areas and whether the vehicle is booked or otherwise.
Hours of Operation
Aviations' normal hours of operation are 24 hours 7 days however the "Kerbside" service is available between 05:30 - 22:00 Monday to Friday, excluding public holidays and by arrangement outside of these hours at the discretion of Aviation.
Payment
In every case payment shall be due at the time of the provision of the services and prior to the return of the customer's vehicle.
Credit Cards & Refunds
In the case of a booking cancellation if within in 14 days a full refund will be issued. If a booking cancellation is within in 2 days a full refund minus a booking fee of $5.00 will charged.
Consumer Guarantees Act.
Nothing
in these terms and conditions shall override the provisions of the
Consumer guarantees Act ("the act") in respect to any
contract to which the Act shall apply. PROVIDED HOWEVER, that in
every case where goods and/or services are provided by Aviation
for the purposes of a business then the provisions of the Act and
all other terms, warranties, conditions implied by statute or under
any other rule of law whether in tort or in contract are expressly
excluded.
